Other FCE vendors believe that their methods which utilize low cost common therapy equipment, such as treadmills, a box of bricks and a stop watch, produce objective, accurate and defendable results. These systems are far from being as truly objective as they claim since a small or unintentional error in the evaluator’s measurement will lead to the difference between a court defendable evaluation and a successful lawsuit dismissing the evaluator’s conclusions. To mitigate this potential loss, these methods often rely upon hedging and giving the evaluee being tested “the benefit of the doubt” rather than producing a truly accurate and objective measure of their ability. In addition, the potential for the evaluator to be heavily influenced by a properly coached evaluee makes the manual system significantly unreliable. This hedging and manipulation of the testing method can result in inequitable decisions.
